I note that in your summary of the decision making process you make no reference to the need to engage with patients and the public under s.242 of the NHS Act 2006 (as amended). In view of the principle of no decision about me without me would it not be possible to give clarity in this area. I note that there is a bit of confusion whether s.242 is engaged before or after the case of change is done. My experience is that in most cases the public are not engaged until after the case of change has been done. However on my reading of s.242 it is engaged before the case for change.
