The request was for weekly data from 23 November 2015 until the most recent data submission regarding the amount of times NHS trusts have used the ‘break glass’ clause to breach the pay cap on agency workers, broken down by the name of each trust and for which kind of worker the pay cap was breached.
NHS Improvement held the information requested and decided to release all of the information it held subject to withholding the names of trusts on the basis of the exemptions in sections 31 and 33 of the FOI Act.
