This document outlines how NHS England intends to exercise its enforcement powers for both integrated care boards (ICBs) (including in relation to patient choice requirements) and providers, including setting out how it would use the powers to direct an ICB and the licence enforcement mechanisms that apply to foundation trusts, NHS trusts, licensed independent providers of NHS services and licensed NHS controlled providers.

NHS England has a statutory duty to consult on the proposed changes to the Enforcement guidance. Following the consultation, the final version of the revised guidance will be issued during 2023/24.
