Spending Review 2021 provided the NHS with a three-year capital settlement covering 2022/23 to 2024/25. This guidance forms the basis of the capital guidance to 2024/25, but will be updated annually to confirm envelopes where relevant and set out any changes or additional envelopes. Final envelopes will be set as far as possible in advance of the relevant financial year.

The Health and Care Act 2022 includes a new discretionary power allowing NHS England to make an order imposing a limit on the capital expenditure of an NHS foundation trust. As part of the Act, NHS England must publish statutory guidance about the circumstances in which we are likely to make an order and the method we would use to determine the limit; this document provides that guidance.
